Thank You for choosing Sears PartsDirect.com and being a valued member. It is unfortunate to hear that you are having issues with your engine and I do understand your frustration. Glad to help out. I'm looking at your model number 12h802-2639-b1 and damage to the rings will cause the smoke quite a bit, as will cylinder wall damage. There is a crankcase breather on you engine (and every other one) that could stick open causing oil to be pushed into the carburetor causing smoke as well. Those things and too much oil can all cause smoke. Black smoke is usually caused by a fueling issue. By that, I mean too much fuel. That can be caused by a failing carburetor. If the valves are out of adjustment you can also have black smoke. An engine that is badly in need of a rebuild will usually have some black smoke and it won't run well. If the crankcase breather is bad or there is an air leak around the oil fill tube or at the oil drain fitting, the engine will burn oil. Look around the engine for signs of an oil leak, if it leaks oil it will draw air into the crankcase and burn oil. Oil leakage into the combustion area in one or more cylinders and a faulty crankcase-ventilation system or even overfilling the engine with oil can lead to minor oil-burning. In any case you may need to open the engine up and see what exactly received damage. I trust this information will help you.

I see no recall for the tank on this unit. I do see that Briggs had changed the tank a while back for a new updated version. The substituted part number of 699374, subbed in from original of 495224 shows that. 
You could go to the Briggs site and inquire further into the status of the tank, but if there was a recall or a situation where the tank was offered to customers at no charge, we would have it notated.
